I’m Roberta Feldman, an attorney with Gray & Feldman, located in Penfield, NY, across from Panorama Plaza. Often people will ask, “How long does it take to get a divorce in New York?” and that really depends on your individual situation:
Do you have children together?
Do you have property together such as real estate?
Personal property, meaning in addition to your vehicles, your household furnishings?
Do you have retirement accounts?
Bank accounts?
Investment accounts?
What about liabilities?
Credit cards?
Mortgages?
All of those issues need to be resolved in your divorce. Even though New York passed a No-Fault statute in 2010, all of those issues must be resolved between yourself and your spouse, with the help of your attorney, or by a judge. So the answer usually ranges from 6 months to 2 years, and that has been my experience.
